TERMS OF SERVICE

1. What WhyNotFamous Is

WhyNotFamous (“the Platform”) is a fan-powered artist discovery service that uses AI agents to investigate and showcase underrepresented artists. The Platform analyses publicly available information and generates investigative reports (“Dossiers”) including Quality-to-Fame Gap Scores.

2. AI-Generated Content Disclaimer

All analysis, scores, expert panel commentary, and dossier content are generated by AI agents using publicly available data. This content is provided for informational and entertainment purposes only. While we strive for accuracy:

  • The analysis may contain errors, hallucinations, outdated information, or incomplete assessments
  • Gap Scores are algorithmic estimates, not definitive judgments of artistic quality or commercial potential
  • The Platform does not guarantee the accuracy of any metrics, fan quotes, or biographical information
  • No investment, business, or talent-scouting decisions should be made solely on the basis of our analysis

3. Service Tiers & Pricing

Free Tier: 3 artist investigations per month. Unlimited browsing of the catalog, map, and existing dossiers. Investigation limits reset monthly.

Fan Pro ($5/month): 15 artist investigations per month. All Free tier features included. Subscription is billed monthly via Stripe.

Industry Pro ($29/month): 50 artist investigations per month. Bulk export capabilities. Priority support. Designed for labels, A&R professionals, booking agencies, and talent scouts.

Artist Boost ($10 one-time): Priority re-investigation of a specific artist with verified badge for 30 days.

4. Payment, Refunds & Cancellation

Payments are processed securely via Stripe. By subscribing or purchasing, you agree to the following:

  • Subscriptions are billed monthly and auto-renew until cancelled. You may cancel at any time from your profile or by contacting us. Cancellation takes effect at the end of the current billing period — no partial refunds for unused days.
  • Artist Boosts are one-time payments. Once the re-investigation has been initiated, the boost is non-refundable as the AI processing costs are incurred immediately.
  • Refund requests for subscriptions may be considered within 48 hours of initial purchase only, and only if no investigations have been used in that billing period. Contact us to request.
  • We reserve the right to modify pricing with 30 days notice to existing subscribers.
  • Chargebacks: Filing a chargeback instead of contacting us for a refund may result in permanent account suspension.

5. Artist Rights

We respect all artists featured on the Platform. We use only publicly available information and embed content from third-party platforms (Spotify, YouTube, etc.) in accordance with their respective terms of service.

  • Artists may request corrections to their profile at any time
  • Artists may request removal of their profile (“right to be forgotten”)
  • Removal requests will be processed within 7 business days
  • We do not claim any rights over the artists' intellectual property

6. Acceptable Use

  • Do not abuse the investigation system (automated bulk requests, scripted access)
  • Do not use the Platform to harass, defame, or misrepresent artists
  • Do not scrape, redistribute, or commercially resell our data without written permission
  • Do not create multiple accounts to circumvent usage limits
  • Do not use the Platform for any unlawful purpose

Violation of these terms may result in immediate account suspension without refund.

7. Limitation of Liability

The Platform is provided “as is” and “as available” without warranty of any kind, express or implied. To the maximum extent permitted by applicable law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • Our total liability for any claims related to the service shall not exceed the amount you paid to us in the 3 months preceding the claim
  • We are not liable for decisions made based on our AI-generated analysis
  • We are not liable for the accuracy of third-party data (streaming metrics, fan quotes, etc.)
  • We are not responsible for service interruptions, data loss, or API downtime

8. Intellectual Property

The Platform's design, code, AI models, Gap Score methodology, and original content are the intellectual property of WhyNotFamous. Users retain ownership of any content they post (wall posts, comments) but grant us a non-exclusive license to display it on the Platform.

9. Industry & API Use

Industry Pro subscribers and API users acknowledge that:

  • Data is for internal evaluation purposes only unless otherwise agreed in writing
  • Public attribution (“According to WhyNotFamous...”) is permitted with link
  • Bulk redistribution of artist data requires a separate data license agreement
  • API rate limits apply as specified in the API documentation

10. Dispute Resolution

Any disputes arising from these terms shall first be attempted to resolve through direct communication. If unresolved within 30 days, disputes shall be subject to binding arbitration under the rules of the jurisdiction in which the Platform operator resides. Class action waiver: you agree to resolve disputes individually, not as part of a class action.

11. Changes to Terms

We may update these terms at any time. Material changes will be notified via email to registered users. Continued use of the Platform after changes constitutes acceptance.
